These Terms of Service (“Terms”) govern your access to and use of the PixelDrive website, dashboard and image-rendering API (the “Service”). By creating an account or using the Service, you agree to these Terms.
01The Service
PixelDrive renders images from templates you design, on demand and in bulk, through a dashboard and an API. We may update, add or remove features over time, and we will give reasonable notice of materially adverse changes.
02Accounts and eligibility
You must provide accurate registration details and keep your credentials and API tokens secure. You are responsible for all activity under your account. You must be old enough to form a binding contract in your jurisdiction to use the Service.
03Acceptable use
You agree not to use the Service to:
- Generate or distribute content that is unlawful, infringing, deceptive or that violates the rights of others.
- Create material depicting the exploitation of minors, or unlawful, harassing or hateful content.
- Circumvent rate limits, billing, security or access controls, or attempt to disrupt the Service.
- Resell or expose raw rendering capacity in a way that competes with the Service, except as expressly permitted by your plan.
04API access, tokens and limits
API access is authenticated by Bearer tokens, which may be scoped and may expire. Free previews and other endpoints may be rate-limited. You are responsible for keeping tokens confidential and for usage they authorise.
05Plans, credits and billing
Paid plans are billed in advance on a recurring basis. Renders are metered against your credit balance; cache hits do not consume credits. Fees are non-refundable except where required by law, and we may change pricing with notice that applies to subsequent billing periods. You can cancel at any time, effective at the end of the current period.
06Your content and intellectual property
You retain all rights to the templates, data and assets you provide and to the images PixelDrive renders for you. You grant us a limited licence to host, process and render that content solely to operate the Service. You represent that you have the rights to the content you submit. We retain all rights to the PixelDrive platform, software and brand.
07Third-party services
The Service integrates with third-party tools and asset sources. Your use of those is subject to their own terms, and we are not responsible for third-party content or services.
08Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.
09Limitation of liability
To the maximum extent permitted by law, PixelDrive will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.
10Indemnification
You agree to indemnify and hold PixelDrive harmless from claims arising out of your content, your use of the Service, or your breach of these Terms.
11Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or to protect the Service. On termination, your right to use the Service ends; sections that by their nature should survive will survive.
12Changes to these Terms
We may update these Terms from time to time. We will revise the “last updated” date above and, for material changes, provide additional notice. Continued use after changes take effect means you accept the revised Terms.
13Governing law
These Terms are governed by the laws applicable at PixelDrive’s principal place of business, without regard to conflict-of-law rules, and disputes will be handled in the courts located there.
